Hi

I was victim of breach of data protection and no compliance of regulations and legal procedures under GDPR Act 2018 from one gaming business.

This was confirm by the Information Commissioner Office (ICO) after I raise my concerns and log a complaint.

At present I'm in the process of take legal action against the same business.

I want to call the attention for this subject because important and critical Personal and Financial Data from thousands and thousands of other gamers are request and hold by the gaming business.

They must comply with regulations and legal procedures under GDPR Act 2018 and make this top priority to keep safe and secure such critical information.

The damage cause by breach of personal and financial data can affect not only the financial aspect of a person life but also the mental health of individuals in a very negative way.

Im still struggle with the situation myself and definitely don't want others to go through the same for this reason this post.

Hello Jorge,

I'm sorry to hear this. To protect other players, can you explain what's happened, please?

Who and how misused your data?

Hi Radka

This begin when during the verification process of my account and a request of funds withdraw by me the business start to make all the process difficult and dragging in time.

During this process I received one email from the business where 2 individual names of Third Parties was disclose. This Information was taken from my bank statement ( provide for the purpose of address verification only). This information was taken and disclose by the business without my consent or authorization and without consent or authorization of the same 2 individuals Third Parties.

This is a very serious breach of data protection and no compliance of regulations and legal procedures under GDPR Act 2018 by the business.

I did question and raise my concerns to the business regarding the issue and not happy with the response I decide to request a Subject Access Request ( SAR). That it's all the data/information the business have and hold from one individual.

They failed to provide with my request in due legal time. For that reason I request 2nd SAR again they failed to provide my request in time. To aggravate the situation they omitted and withheld in my SAR request the name of the 2 individual Third Parties disclose as described above. In this situation my rights as person and consumer it's been denied where the business don't comply with regulations and legal procedures under GDPR Act 2018 .

I decide to expose the situation to the UKGC that advice me to log a complaint with the Information Commissioner Office (ICO).

I raise the complaint with ICO on they website. With this I send all the emails exchange between me and the business as evidence and proof to re enforce my complaint.

The ICO contact the business with instructions for them to address the issue and clarify my concerns raise.

The ICO didn't have any response back from the business in the 2 occasions they been ask to.

The ICO review my case and concluded the business had breach data protection and failed to comply with regulations and legal procedures under GDPR Act 2018.

This business not only failed with they legal obligations but and also show enormous lack of customer service and customer care when dealing with this situation.

This situation cause me financial losses and more worst then that damage my health with mental stress and anxiety disorder.

In my experience getting familiar with our rights as person and consumer regarding our data/information hold by business did help me in this situation.

Also any email/communication between the individual and the business it's vital so keep safe.

I was made aware when a business apply for a gaming licence there's no requirement to show evidence they are ready and committee to comply with GDPR regulations or supervision of the same. The licence it's award by the UKGC. In my opinion I don't agree with this.

Individual personal and financial information should be deal with maximum security safety and trust not as another tick box.

Thank you for this clarification. I just can't figure out, how anybody can avoid this situation.

Do you have any suggestions?

Radka

I think it's very difficult to avoid this type of situation.

As a gamer or any other individual need to provide personal and financial information for almost everything nowdays. So really isn't not in our hands to prevent this to happen.

It's the business responsibility to prevent this to happen. They should comply with legal procedures and regulations under the GDPR.

Also in my opinion the UKGC should be more active regarding this issue making sure all the gaming business do follow the GDPR Act and have what needed In place to avoid this to happen.

If necessary withdraw or suspend the respective gaming license if this type of situation occurs often. I did feel that breach of data protection isn't not taken serious by the UKGC but it's them who award the licenses and regulate all the industry so they should be accountable for it also.

To answer to your previous question:

Jumpman Gaming Limited and the respective website All Start Games was where this issue occur.

This business was fine by the UKGC recently over £500,000 for :

breach of Licence Condition 12.1.1 Paragraphs 1, 2 and 3 - Prevention of money laundering and terrorist financing

breach of Paragraph 1 of Licence Condition 12.1.2 (Anti-money laundering measures for operators based in foreign jurisdictions)

failure to comply with Social Responsibility Code Provision 3.4.1 paragraph 1 and 2 - Customer interaction.

I believe nothing more need to be said. Against facts there's no arguments.

Hi Jorge, I'm just wondering, was the casino (or the gaming business you're talking about) licensed in the UK or not?

Following up my dispute with Jumpman Gambling the Court had issue a County Court Judgement (CCJ) against the company. This refer to Breach of Data Protection compensation claim that was ignored and dismiss by them.

Obvious they file an aplication to set aside the CCJ paying the respective fee over £300. Arrogancy disrespect and presumption attitude was showed on that aplication when presenting the reasons to set aside the CCJ. Unfortunately for them and against they wish the Court decide to arrange a hearing in Brighton where I live.

The hearing will be held next week where I will have the opportunity to prove in front of the Judge my claims and put right what is wrong.

Almost one year ago when my ordeal whit this company start. Hopefully will come to an end next week or maybe not...the fact I bring them to court is already a small win.

There's no one above the law definitely Jumpman Gaming Limited isn't not.

Hi Radka

As expected Jumpman Gaming Limited didn't show up for the hearing to defend the application to set aside the Judgement. Unfortunately they are playing dirty but hopefully will not be for long.

My next step will be enforce the CCJ.

I had attached the CCJ Register that will be in they records for 6 years if not settle with all the repurcasions associated with it.

Hello,

I must say that I'm not quite familiar with this CCJ, how does it work, please?

hace 2 años

Hi Radka

CCJ is issue against person/business when money is own to other. If that money wasn't paid as request the court issue the CCJ. Can enforce if not paid in 1 month after be issued.

CCJ is register and stays on record for 6 years on person/business file where bank and credits agency's can access.

This damage the credit report/score and make difficult go get credit or other financial products in future.

Some businesses don't hire persons if they have CCJ on they records.

Hello,

now I understand a bit more. It's a similar institution to the register of debtors as we call it in the Czech Republic.

I hope it helps your cause though.

this is very serious and breach of data protection laws. this is very serious matter that ico needs to act now. my advice is to contact the data protection solicitors they do no win fee. They can help you with serious breaches of your data has been misused which jumpman gaming done.

you need let the ico invesgiated bit longer because they are busy with other ico breaches.

as for jumpman gaming is not good handling your personal data like this at all i hope you received compension from them by a solicitor who deals with data protection laws

fileHi

I did ask for compensation. But obvious they alleged that data protection wasn't breach against the ICO report.

They refuse to pay and for that reason the Court issue a CCJ against them. They still are completely ignoring this situation.

The UKGC is full informed about the situation but its frustrating to see no action or reaction from them. As license provider and regulator I felt that the money coming from the gaming industry its a priority. Leaving myself and thousands of others unprotected against this nasty and despicable behaviour like Jumpman Gaming Limited.filefile
