Yep thats how shady it is. But its okay.. kansspelautoriteiten knows about Westcasino and will start investigation.

Many players have complained.. send screenshots etc

Hey.

I checked your recently closed complaint. Well, it truly requires a full explanation, so allow me to quote from the final summary:

"Dear rotarnicolaemihai,

After gathering all the necessary information and details, we decided to close this complaint as unjustified. Although some of the reasons were explained earlier and several times, I would like to summarize and explain all of them in detail.

1 - Registration from the Netherlands

Each player is obliged to read the terms and conditions before their acceptance. This is done upon registration, and you agreed with them. It is the player's responsibility to know the law in their country of residence. Even if the casino removed the Netherlands from the countries list after your account closure, it would be irrelevant regarding this case and the related issues. Like in any other casino, you could play there, and you had a chance to win like any other player, but you also risked losing. The funds were lost by playing in the casino. If you had won, the casino should have paid you your winnings, and we would have been on your side for sure. However, if we look at the situation from your sight - it would mean that players registered in this way would never lose anything. They could only win or, in case of loss, get their deposit(s) back. It does not work like that at all. All players who were allowed to play in the casino in this way could only take this opportunity as an advantage, but at the same time take the risk of losing their money - like in any other online casino.

In addition, the casino has the right to close a player's account at any time without a reason. In such a case, it should pay the whole remaining balance to the player. Since your balance at the time of account closure was 0, the casino acted correctly and within its terms and conditions, and we accept it.

2 - Reward €200 (cash bonus) from the tournament

If I understood the casino's decision correctly, it was not made due to your country of residence. The decision was made because you marked it as a violation of the law in your country by the casino, which is not completely correct, and you planned to turn to the authorities. From this point on, anything provided by the casino could be used against the casino itself. Another thing is that we are talking about bonus money. It means that mainly General Bonus terms and conditions apply, and the casino has the right not to provide you with it at its sole discretion.

This is the rule stating it directly in the casino's T&Cs (available HERE, GENERAL BONUS T&Cs - rule 1.):

"We reserve the right to limit players from other jurisdictions from being eligible to any type of bonus or to a subset of bonuses based on our sole discretion."

Unfortunately, if the casino decided not to give you this type of reward, this is in accordance with their T&C and we accept it.

3 - Game history

Based on the above, we have sufficiently investigated and considered the issues and do not consider it necessary to ask the casino to provide a complete history for this purpose. Therefore, I recommend you turn to the authority and request your gaming history from them. The casino should be able to provide it based on their request.

For all the Dutch players, Westcasino will not respond on your complaints or GDPR requests as this is not in their interest. They are aware (like many other casino's) that Dutch gamblers can claim their losses back on the casino since they operated illegal here.


They are also ignoring my complaints mails at all as they hope to dodge the claim with that. But the law firm is preparing class actions against the casino operators which I will join.


For those who filed a GDPR request, if the casino fails to respond within a month you can rise a complaint to the DPO Authority of Malta to force the casino to comply with European legislation, and get your personal data you requested.


And as known in the media about a law firm that is willing to defend duped players, it might be worth it to forward your case to them as maybe the casino will then chicken out and pay your claims instead of going to court to lose and allow others to use this as case law(Jurisprudentie).


It is great to see that all those casino's operated illegally here and being aware of this but in the meantime pretend that it is not the case.

€12,6 mln to the N1 Group

€9,87 mln to videoslots (for abusing their logo)

€1,78 mln to 21.com


This is because the casino's operated illegally in The Netherlands.


But I will create an separate topic about this.

Yea they finally got there fines. Now lets hope the other casino's who do not cooperate will aswell. Thats why its important to report them to the kansspelautoriteiten.

A few casino's who still go on with offering games illegaly without a dutch liscense:


- Westcasino

- Brunocasino

- Playboom24


These are 3 big casino's who still act without a dutch liscense and keep targeting the dutch market.

They are shown on dutch affiliates sites who lure dutch players in. But they are all rogue casino's for dutch players.

You're explanation is non sense,from all this ridiculous story and experience i can say that i don't care anymore for those money that I've spent.

I'm the most Happy guy now because I've stopped gambling,i have almost 3 months.

This happen after 15 years .

And around 500k lost.

So if west casino give me back the refund or not is not a strees for me anymore,they can keep the money and buy candles with them 😂

Based on what I read here, I believe the Casino Guru's point of view is simply different compared to yours and some other players that joined the discussion. We have a main goal in Casino Guru and that's "recommending casinos that are fair towards players".

The main question is if the casino paid Dutch players that won there without writing them excuses about missing licenses and restricted countries. If the casino decided to accept Dutch players knowing that they shouldn't, but they also decided to pay in case they won, then the casino acted fairly.

I'd like to see a single Dutch player who won in those casinos returning the winnings to casino, claiming that the winnings weren't deserved since the player shouldn't play there.

The casinos never forced anyone to play there. If you decided to join them, it was clearly a choice that you made on your own.

This casino got a fine from the Dutch Gambling Authority for still being active in The Netherlands, I do believe that this would ease a refund for the involved players since the casino operates illegally here.

Well that's the hard part. Many Maltese based casino's and Curacao based ones (which have a European agent) are required to comply with your refund request as they operated illegally in The Netherlands. And since European laws are applicable you can bring them to a Dutch court (consumer regulation allow this).


The problem is all these casino's know that many players wont go to court for amounts of €1000-2500 as a court case will take months maybe even years if you have bad luck and you will have to prepay all legal costs during the court case. It is simply not worth the effort and many casinos count on this (or hope at this).


Once you have a ruling which I believe should be in favor of the player (as a Dutch law firm also confirms) the casino will have to reimburse your lost money, your legal fees made, legal interest and any compensation fees etc. as you are being duped as a Dutch player.


Thats why I am waiting on rulings from the Dutch law firm that are pending because once there are rulings made in favor of the players those cases become case law in other similar cases making it much easier to get your lost funds back.


This is for the casinos where you played before October 1st 2021, all casinos afterwards are clearly in breach if they have no license with the KSA leaving no doubt that they are operating illegal.


Many Curacao based casinos and some Maltese are still offering illegal services to The Netherlands which is sad but means that if you play and lose you can claim all losses back on the casino as they are aware of their illegal operation.


From Antillephone (8048/JAZ), Curacao Interactive Licensing (5536/JAZ) and Gaming Curacao (365/JAZ) I know they have mentioned in their license that it is forbidden to operate in or target The Netherlands. So if any of their sub licensee casino do operate they are in breach of their own license..



It also goes the other way around a casino can also sue a player if he earned a lot of money on an 'illegal' casino, however casinos wont do this because the player is protected as he is probably unaware of this. And if a casino does go to court it is likely that the judge will still rule in the favor of the player/consumer but also order the casino to refund all Dutch players that have a a loss on their casino.


So just like in Austria and Germany is happening now The Netherlands is the next country starting to claim against the casinos.



I know Casino Guru does not agree on this opinion but for what it is worth all of the above is happening/possible due to local legislation which many casinos did know when they offered their services illegally in here and now players start to claim their losses back.


For Dutch gamblers that are duped or even got addicted due to this it might be worth to contact the law firm that is willing to represent Dutch gamblers and they can also forward you to the right help organizations.

Casino claims they accept crypto as a payment method, but there is no option at all anywhere to do so. I do remember making a couple crypto deposits in the past (which was the reason I registered, because I don't know any MGA casino that accepts crypto) but months ago said payment method dissapeared, supports claims crypto is still accepted but the option doesn't exist at all, I suppose crypto transactions might go against the policies enforced by the MGA (?) file
